Use of the website

The content of this website is for information. The descriptions of our services, the results of our projects and the news are not a contractual offer: what we do for you, and on what terms, is set out in the written proposal we send you.

The prices shown on the website include VAT at the current legal rate. A service marked “Price on request” is priced in a proposal, once we know your case.

You agree to use the website lawfully: without trying to enter restricted areas that are not yours, without interfering with how it works, and without using it to send unlawful content or malicious software.

Intellectual property

The texts, photographs, drawings, logos and code of this website belong to Âmago or to those who have allowed us to use them. You may view them and share links to the pages; to copy, change or use them in any other way you need our written permission. The names and logos of our clients and partners belong to their owners.

Links to other websites

This website links to third-party websites, such as LinkedIn or the official complaints book. We are not responsible for the content or the rules of those websites.

Liability

We do our best to keep the information on the website accurate and up to date, and to keep the website and the portal available at all times, but there may be interruptions for maintenance or for reasons beyond our control. We are not liable for damage caused by an interruption or by an error in the information on the website, except in the case of wilful misconduct or gross negligence, or where the law does not allow that liability to be excluded.

2

Quote requests

A quote request made on the website does not bind you, or us, to anything. We reply with a written proposal setting out the scope of the work, the price and the timescales. The contract is made when you accept the proposal.

The Client Portal

Âmago creates a Client Portal account for each client. You choose the password yourself, through a single-use link, and no one at Âmago knows it. You are responsible for keeping it secret and for what is done with your account; if you suspect someone else has used it, let us know at once.

The documents you send through the portal must be yours, or you must be allowed to share them with us, and they must not contain malicious software. Every file is checked when it arrives, and we may refuse any that does not pass that check.

We may suspend an account that is used against these terms or that puts the security of the portal at risk.

Orders

Once you accept a proposal, we create the order in your Client Portal, with a description of the service and the amount including VAT. Any discount is shown on the order. Each order is paid in two parts: a 50% deposit, paid before we start (the work only begins once we have received it), and the remaining 50%, requested when the work is finished.

3

Payments

You can pay in the Client Portal by MB WAY, by Multibanco reference or by card. These payments are processed by Easypay, a payment institution authorised by the Bank of Portugal; Âmago never sees or stores your card details. You can also pay by bank transfer, quoting the order reference (AMG-…); in that case, the payment is recorded when we receive it.

A pro-forma invoice shows the amounts to be paid and is valid for 30 days, but it is not an invoice. The invoice is issued by our certified invoicing software.

When a payment is outstanding, we send you reminders by email.

Cancellation and refunds

As long as no payment has been made, an order can be cancelled at no cost, by you or by us.

If we do not deliver the service within the agreed timescale, we refund your deposit within 10 working days.

The deposit is not refunded if you do not send us the documents needed for the work, or if it is not possible to carry out the site survey, within 30 days of paying the deposit.

Refunds are made by the same payment method, unless agreed otherwise.

Right of withdrawal

If you are a consumer and the contract is made at a distance or away from our office, the law gives you 14 days to withdraw without giving a reason. For us to start the work within that period, we ask you to request it expressly and to acknowledge that you lose the right of withdrawal once the service has been fully performed. If you withdraw before then, you pay for what has been done up to the moment you tell us. This right does not apply to contracts with businesses.

4

Complaints and disputes

If you are not satisfied with a service, please talk to us first, at amago@amago.pt or (+351) 282 044 650 (call to the national landline network): we always try to resolve the matter directly. You can also use the official online complaints book.

Privacy

How we process your personal data is explained in the Privacy Policy.

Governing law

These terms are governed by Portuguese law. Disputes are settled by the courts of Portimão, Portugal, without prejudice to the rules that protect consumers, who may always go to the courts where they live.

Changes to these terms

We may update these terms when our services or the law change. The version in force is always the one on this page; orders already placed keep the terms that applied when they were placed.
